Terms and Conditions
These Terms and Conditions (“Terms”) govern your access to and use of Vastlink (the “Service”), built by Vastlink Pty Ltd (ABN: 76681479998) (“Vastlink,” “we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms.
1) Non-Custodial Nature
- Vastlink is a non-custodial wallet as a service. We do not hold, custody, control, or manage your digital assets, private keys, seed phrases, recovery material, or multi-party approval policies.
- You retain full control and responsibility over your assets and any cryptographic material (including distributed key shares, if applicable).
- We cannot initiate transactions on your behalf, block, freeze, reverse, or otherwise access your assets.
2) Your Responsibilities
- Access & Credentials: You are solely responsible for safeguarding your access methods (e.g., email, passkeys, MFA, device security, hardware security keys, organization policies, multi-signer rules). Vastlink cannot restore access if you lose them.
- Approvals & Governance: For organizations, you are responsible for establishing and maintaining your own internal approval workflows, signer policies, and account governance. Vastlink is not responsible for disputes among your users, admins, or signers.
- Irreversibility: Blockchain transactions are typically irreversible. Verify addresses, networks, amounts, and fees before authorizing any transaction.
- Compliance: You must comply with all applicable laws, regulations, tax obligations, and sanctions regimes in your jurisdiction.
3) No Financial, Legal, or Tax Advice
Vastlink provides technology only and does not provide financial, investment, legal, accounting, or tax advice. You should seek professional advice before making decisions involving digital assets.
4) Risks You Accept
- Price volatility; smart-contract, protocol, or network failures; forks; congestion; slippage; front-running; MEV; phishing; malware; device compromise; loss of credentials; human error.
- Third-party dependencies (e.g., identity providers, analytics, hosting, or blockchain networks). These are outside our control.
- You acknowledge and accept these risks when using the Service.
5) Third-Party Services & Links
The Service may interface with or link to third-party services (e.g., identity providers, communication tools, blockchain networks, wallets, or dApps). We do not control and are not responsible for third-party acts, omissions, security, or content.
6) Eligibility
- You must be at least 18 years old and have the legal capacity to enter into these Terms.
- By using the Service on behalf of an entity, you represent that you are authorized to bind that entity, and “you” includes the entity.
7) Acceptable Use
- Do not use the Service for unlawful activities, money laundering, terrorist financing, sanctions-evasion, or to violate others’ rights.
- Do not interfere with the Service, attempt unauthorized access, or misuse APIs.
8) Intellectual Property
We and our licensors own the Service and related content (excluding your content). Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service. You may provide feedback; we may use it without restriction or compensation.
9) Changes, Availability & Beta Features
- We may modify, suspend, or discontinue features at any time.
- Beta or experimental features may be unstable and are provided “as is.”
10) Warranty Disclaimers
To the maximum extent permitted by law (including the Australian Consumer Law), the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or meet your requirements.
11) Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or opportunities, arising out of or related to your use of (or inability to use) the Service, including but not limited to user error (e.g., wrong addresses), lost credentials, unauthorized access due to device compromise, or blockchain/network issues.
12) Indemnity
You agree to defend, indemnify, and hold harmless Vastlink and its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of law or third-party rights.
13) Governing Law & Venue
These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have exclusive jurisdiction.
14) Changes to These Terms
We may update these Terms from time to time. We will indicate the “Last updated” date above. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
15) Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision is unenforceable, the remainder remains in effect.
- Assignment: You may not assign these Terms without our consent. We may assign these Terms.
- No Waiver: Our failure to enforce a provision is not a waiver.
